Chapter One General Provisions Article 1 In order to accelerate the construction of the emergency management technology innovation system, standardize and strengthen the construction, operation and management of the Key Laboratory of the Emergency Management Department (hereinafter referred to as the "Key Laboratory"), according to the optimization and integration of the National Science and Technology Innovation Base Program (Guokefaji [2017] No. 250), "Several Opinions on Strengthening the Construction and Development of National Key Laboratory" (Guokefaji [2018] No. 64), etc., refer to the "National Key Laboratory Construction and Operation Management "Measures" and other documents, formulate these measures.
The second key laboratory is an important part of the emergency management technology innovation system, and is an important scientific and technological innovation base organized by the emergency management department for high-level basic research, applied basic research, technological innovation research and development, scientific and technological personnel training, transformation of scientific and technological achievements, and cooperative exchanges. .
Article 3 The main tasks of the key laboratories are to meet the actual needs of emergency management, optimize and integrate superior scientific and technological resources, carry out basic theoretical research on safety production, disaster prevention and mitigation and emergency rescue, key technical research and advanced equipment research and development, in order to promote the emergency management system And provide technological support for capacity modernization.
Article 4 The key laboratories mainly focus on the construction of emergency management related fields and the application of cutting-edge technologies:
(1) Basic research. Layout and construction of key laboratories in basic research and applied basic research in the fields of natural disaster prevention, production safety accident prevention and control, emergency rescue, etc.
(2) Key technical breakthroughs. Layout and construction of key laboratories in technical research areas such as natural disasters, production safety accident risk perception recognition, monitoring, early warning and forecasting, risk prevention and control.
(3) Research and development of advanced equipment. Layout and construction of key laboratories for research and development of natural disaster rescue, production safety accident rescue, fire fighting and other equipment.
(4) High-tech application. Layout and construction of key laboratories for innovative applications of high-tech technologies such as cloud computing, Internet of Things, big data, artificial intelligence, satellite remote sensing, wireless communication, and virtual reality in the field of emergency management.
Article 5 The key laboratories should focus on the responsibilities and research areas, adhere to the correct scientific research direction, pay attention to the transformation of scientific and technological achievements, and actively play a supporting role. Key laboratories based on basic research should aim at the forefront of emergency management science and technology to carry out research on high-level theories, methods, and common technologies, and strive to improve the basic theory level of emergency management and knowledge innovation capabilities; key technology research, advanced equipment development and Key laboratories focusing on technological innovation, such as high-tech applications, should be guided by practical applications, strive to break through key technologies such as disaster prevention and prevention, develop advanced rescue equipment, and promote new technology and new equipment in monitoring and early warning, supervision and law enforcement, auxiliary command, and rescue Effective application in actual combat and social mobilization.
Article 6 The key laboratories implement the operating mechanism of "openness, mobility, alliance and competition", and insist on establishing, classifying management, periodic evaluation and dynamic adjustment on demand.
Article 7 Key laboratories are scientific research entities built on the basis of scientific research institutes, colleges and universities, enterprises and other units (hereinafter collectively referred to as "relying units"), and encourage the implementation of relatively independent management mechanisms on human, financial and physical properties.
Chapter 2 Management Responsibilities Article 8 The Emergency Management Department is the certification and management department of key laboratories. The main responsibilities are:
(1) Macro-guide the construction and development of key laboratories.
(2) Issue rules and regulations for the management of key laboratories.
(3) Approval of the establishment, merger and withdrawal of key laboratories.
Article 9 The Department of Science and Technology and Information Technology of the Ministry of Emergency Management is the centralized management unit of key laboratories. The main responsibilities are:
(1) Organize and formulate key laboratory development policies and related management regulations.
(2) Organize the application and construction of key laboratories, and specifically guide the operation and management of key laboratories.
(3) Organize the evaluation and evaluation of key laboratories.
Article 10 The relying unit is the main body in the construction, operation and management of key laboratories. The main responsibilities are:
(1) Provide guarantee conditions for the construction and operation of key laboratories, and solve related problems encountered during the construction and development of key laboratories.
(2) Appoint the directors of key laboratories, directors and members of academic committees.
(3) Responsible for the standard operation and management of key laboratories, cooperate with the emergency management department to do the acceptance and evaluation of key laboratories, and review the authenticity of materials such as the application for key laboratories, construction tasks, construction summary reports, and annual reports. Accuracy, and bear joint and several liability for material inaccuracy.
Chapter III Application and Establishment Article 11 The Emergency Management Department organizes the application and establishment of key laboratories in a combination of top-down and bottom-up methods based on the needs of emergency management business development and technological innovation system construction.
(1) From top to bottom. The Emergency Management Department issued key and planned application notices for key laboratory construction in light of actual needs, and organized review and establishment according to procedures.
(2) Bottom-up. Encourage relevant units that have the qualifications to apply for key laboratories to submit applications for the construction of key laboratories where emergency management urgently needs professional fields and directions at any time. The Emergency Management Department will organize the review and establishment according to the procedures.
Article 12 The application for key laboratories shall meet the following basic conditions:
(1) The research direction and research content are reasonable, in line with the development needs of emergency management, and have clear research goals and development plans.
(2) Strong research strength, having an important influence in the field of emergency management, obtaining excessively high-level scientific research achievements, and having the ability to undertake major scientific research tasks.
(3) Having a high-level academic leader, a high-level research team with a reasonable structure, and the ability to train emergency management scientific research personnel.
(4) Having good conditions for scientific research experiments, personnel and research sites are relatively concentrated.
(E) The relying unit must ensure the construction and operation of key laboratories and provide supporting conditions such as logistics support.
Article 13 The process of applying for key laboratories:
(1) Relying on the organization to prepare the "Application for Key Laboratory of Emergency Management Department" (hereinafter referred to as "Application", the format is shown in Annex 1) and apply. If the relying unit is a unit directly under the Ministry of Emergency Management, the application letter and the "Application" shall be submitted directly to the Department of Science and Technology and Information Technology of the Ministry of Emergency Management. China Earthquake Administration, National Coal Mine Safety Supervision Bureau, Emergency Management Departments (Bureaus) of various provinces, autonomous regions and municipalities directly under the Central Government, Xinjiang Production and Construction Corps Emergency Management Bureau, Fire Rescue Bureau of the Emergency Management Department, Forest Fire Bureau, and relevant departments of the Emergency Management Department can recommend Qualified relying units applying for key laboratories must submit recommendation letters, relying unit application letters and "applications".
(2) The Science and Technology and Information Department of the Ministry of Emergency Management conducts a formal review of the "Application Form" to confirm the completeness of the materials and whether they meet the basic requirements for key laboratory applications.
(3) The Science and Technology and Information Technology Department of the Ministry of Emergency Management organizes experts to review the "Application" that has passed the formal review. The evaluation expert group is composed of 9 or 11 experts in principle, and is selected according to the discipline matching and avoidance principles (inviting relevant business departments and bureaus to recommend experts in the corresponding field to participate according to the evaluation needs, not exceeding 1/3 of the evaluation expert group), and in Before the review, do a good job in keeping the list of review experts confidential. After listening to the report and reviewing the application materials, the review experts conduct on-site scoring and issue review opinions to produce a list of candidate key laboratories.
(4) The Department of Science and Technology and Information Technology of the Ministry of Emergency Management organizes on-site verification of candidate key laboratories, verifies whether the application materials are consistent with the actual situation, and forms an on-site verification opinion.
(5) The Emergency Management Department will publicize the key laboratories that have passed the on-site verification according to the procedures. If there is no objection to the publicity, the official approval shall be granted for the establishment.
(6) Relying on the approval of the Ministry of Emergency Management, the relying unit organizes the preparation of the "Mission Key Laboratory Construction Task Document" (hereinafter referred to as the "Mission Book", the format is shown in Annex 2), and organizes experts to conduct feasibility studies. ”And the argument report are reported to the Department of Science and Technology and Information Technology of the Ministry of Emergency Management for record.
Article 14 Construction and acceptance of key laboratories:
(1) The construction of key laboratories adheres to the principle of "construction, operation and improvement". The construction of key laboratories should be carried out strictly in accordance with the contents of the "mission statement". The construction period generally does not exceed 1 year, and the construction funds are self-raised by the relying unit. Encourage key laboratories to raise funds through various means such as local finance or social funds. The use of funds should be open and transparent and used only for the construction and operation of key laboratories.
(2) After completing the construction tasks as planned, the relying unit organizes the preparation of the "Summary Report on the Construction of the Key Laboratory of the Emergency Management Department" (see Annex 3 for the format), and submits an application for acceptance to the Emergency Management Department. Experts of the Department of Science and Technology and Informationization of the Ministry of Emergency Management organized acceptance.
(3) The key laboratories that have passed the acceptance will be publicized by the Emergency Management Department. If there are no objections to the publicity, they will be officially included in the key laboratory operation sequence. If the acceptance cannot be carried out on schedule or the acceptance fails, the construction qualification shall be cancelled.
Article 15 Encourage the application of key laboratories in the form of strong cooperation and collaborative construction to enhance the innovation capabilities of key laboratories. The joint application shall meet the following conditions:
(1) The number of joint application units shall not exceed 3 in principle, and the lead unit shall be clearly defined. The lead unit shall comply with the provisions of Article 12 of these Measures.
(2) The lead unit is in charge of the application and construction of key laboratories, and the participating units cooperate with the relevant work according to the requirements of the lead unit.
(3) After the key laboratory has passed the inspection and acceptance, the lead unit will take the lead in the daily operation and management and accept regular evaluations.
Chapter IV Operation and Management Article 16 The operating funds of key laboratories are mainly self-raised by the relying unit, and the Emergency Management Department actively supports them by striving for relevant policies.
Article 17 Key laboratories implement the system of relying on the leadership of the unit and the director responsibility under the guidance of the academic committee.
Article 18 The director of a key laboratory should generally be a fixed person in a supporting unit, and be a high-level academic leader in this field, with strong organizational management skills, generally no more than 60 years of age. The term of each term is 5 years, and the working hours in key laboratories are generally not less than 8 months per year. Those who pass the examination can be re-elected.
Article 19 The Academic Committee is the academic guidance organization for key laboratories. Its main task is to review the development goals, research directions, major academic activities, annual work plans and annual reports of key laboratories. The formation of the academic committee should meet the following requirements:
(1) The academic committee is composed of outstanding experts in the industry, and the total number of members should be singular and not less than 9 and not more than 15, including not more than one-third of the personnel of the relying unit.
(2) The director of the academic committee should generally be a person from a non-reliance unit, and should be a high-level academic leader in the field, with a senior professional technical title and strong organizational management capabilities.
(3) The meeting of the Academic Committee shall be held at least once a year, and the number of participants shall not be less than two-thirds each time.
(4) The term of the academic committee is 5 years, and more than one-third of the members should be replaced each time they are renewed. In principle, those who do not attend the academic committee meeting twice should be replaced.
Article 20 Key laboratories shall strengthen operation management and establish and improve internal rules and regulations. It is necessary to strengthen the openness of housekeeping and make decisions on major issues open and transparent.
Article 21 Key laboratories should pay attention to the construction of academic echelons and outstanding young and middle-aged talents, stabilize the high-level scientific research team, maintain a reasonable staff structure and scale, and flow appropriately.
Article 22 Key laboratories shall ensure the efficient operation of scientific research equipment, and share scientific research equipment and data on the premise of meeting confidentiality regulations.
Article 23 The key laboratories should focus on the actual needs of emergency management, strengthen the contact and cooperation with the innovative forces of all parties in the industry, universities and research institutes, and accelerate the transformation and application of outstanding scientific research results.
Article 24 Key laboratories should increase their open cooperation and strive to become a high-level research platform in this field of expertise; actively carry out international and domestic scientific and technological exchanges and cooperation, participate in domestic and foreign scientific and technological planning projects; Laboratory open topics and other methods have widely attracted domestic and foreign researchers to carry out cooperative research.
Article 25 Key laboratories should attach importance to the construction of scientific ethics and academic style, strict academic discipline, and create a good environment for scientific research. In case of serious academic misconduct, the Emergency Management Department may take measures such as notification and criticism until the key laboratory qualification is revoked, as appropriate.
Article 26 The key laboratories shall strengthen the protection of intellectual property rights. The monographs, papers, software, databases and other research results completed in the key laboratories shall be marked with the name of the key laboratories. Relevant regulations.
Article 27 If a key laboratory needs to change its name or change its research direction, the director of the key laboratory must submit a written application, and after the academic committee has demonstrated it, the supporting unit should report it to the Emergency Management Department for approval.
Chapter V Assessment and Evaluation Article 28 Key laboratories must carry out annual self-assessments and prepare annual reports. After being reviewed by the relying unit, the annual report shall be reported to the Emergency Management Department for the record before the end of January of the following year.
Article 29 The Ministry of Emergency Management conducts annual assessments of key laboratories, comprehensively understands and inspects the operation status of key laboratories for one year, summarizes experience and achievements, discovers problems, and promotes the development of key laboratories.
Article 30 The evaluation contents of key laboratories mainly include: research level, achievement transformation, actual combat application, team building, talent training, operation management, open communication, etc. The evaluation rules for key laboratories shall be formulated separately.
Article 31 The evaluation results of key laboratories are divided into four grades: excellent, good, rectification and failure.
Article 32 The evaluation results are excellent key laboratories, and priority may be given to applying for the national key laboratories, and priority shall be given to the relying unit for applying for scientific and technological projects of the State and the Ministry of Emergency Management. The results of two consecutive evaluations are excellent key laboratories. You can apply for the next round of evaluations through the relying unit, and the results are considered good. The results of the three consecutive evaluations are excellent key laboratories. You can apply for the next round of evaluations through the relying unit, and the results are considered excellent.
Article 33 The evaluation result is a key laboratory for rectification. The rectification shall be carried out against the content of the evaluation. The rectification period shall not exceed one year. The evaluation results of the key laboratories that passed the rectification evaluation shall be deemed good. Those that have not passed the rectification assessment will no longer be included in the sequence of key laboratories.
Article 34. Key laboratories that have not passed the evaluation, key laboratories that did not participate in the evaluation or withdrew from the evaluation without proper reason, will no longer be included in the sequence of key laboratories.
Chapter VI Supplementary Provisions Article 35 The key laboratories are uniformly named as “Key Laboratory of Emergency Management Department”, and the English name is “Key Laboratory of ××, Ministry of Emergency Management”.
Article 36 The Measures shall be interpreted by the Department of Science and Technology and Information Technology of the Ministry of Emergency Management.
Article 37 These measures shall take effect as of the date of promulgation.
