Article 3 The road traffic safety work in this Municipality shall follow the principle of managing and facilitating the masses according to law to ensure the orderly, safe and unimpeded road traffic.

Article 4 The management of road traffic safety in this Municipality shall be compatible with economic construction and social development, urban layout and traffic demand. Urban planning should be coordinated with road traffic safety, rationally allocate road resources, improve transportation infrastructure, develop public transport, and improve the modernization level of road traffic safety management.

Article 5 The municipal, district, and county people's governments shall lead the management of road traffic safety, organize relevant departments to determine management objectives, increase investment in road traffic safety infrastructure and scientific and technological management methods, and establish and improve coordination mechanisms for road traffic safety management. The traffic impact assessment system for major construction projects and the responsibility system for road traffic safety prevention; road traffic safety management planning and implementation plans for road traffic safety facilities, traffic and civilized construction, scientific research and application, and organization and implementation.

Article 6 The traffic administrative department of the public security organ of this Municipality shall be responsible for the road safety management within the administrative area of ​​this Municipality.

The departments of transportation, planning, construction, municipal administration, environmental protection, agriculture, development and reform, and urban management and supervision of the municipal, district and county people's governments shall, according to their respective duties, be responsible for the relevant road traffic work and implement the responsibility for road traffic safety.

Article 7 The traffic management department of the public security organ and its traffic police shall perform their duties in accordance with the law and enforce the law strictly, impartially, and civilly.

The traffic management department of the public security organ and its traffic police should modelly observe the road traffic safety laws and regulations.

Article 8 The municipal, district and county people's governments and their relevant departments shall carry out road traffic safety publicity and education to improve the citizens' road traffic safety awareness and the quality of transportation and civilization.

Organs, military units, enterprises, institutions, social organizations, and other organizations should do a good job of their personnel's traffic safety education work and the management of their vehicles, and implement a road traffic safety prevention responsibility system.

Schools shall incorporate road traffic safety education into the content of legal education. Primary and secondary schools shall incorporate students’ compliance with road traffic safety laws and regulations into comprehensive assessment.

The relevant units of news, publishing, broadcasting, television, etc. shall strengthen publicity and education of public road traffic safety.

Article 9 This Municipality encourages units and individuals to provide volunteer services under the unified organization of the traffic management department of the public security organ to help maintain road traffic order.

Citizens, legal persons and other organizations that have made outstanding contributions to road traffic safety work should be commended and rewarded by the people's governments at all levels in this Municipality.

Chapter 2 Vehicles and Drivers

The first quarter motor vehicle

Article 10 When applying for the registration of a motor vehicle, the applicant shall provide authentic, valid and valid certificates and vouchers. Where there is a change in the content of registration of a motor vehicle, the relevant formalities shall be handled in accordance with the provisions.

Article 11 The traffic administrative department of the public security organ shall complete the examination within 5 working days from the date of accepting the application for the registration of the motor vehicle, and shall issue the registration certificate, number plate and driving license of the motor vehicle if it meets the prescribed conditions; If the conditions are specified, the applicant shall explain the reasons for not registering.

The registration of motorcycles and road special operations vehicles shall comply with the city's traffic development plans and shall implement total control within the limited areas.

Article 12 During the registration of motor vehicles for registration in this Municipality, if a motorized vehicle needs to be temporarily driven on a road, it shall obtain a motor vehicle movement certificate, and shall drive according to the valid period and the driving area specified in the movement certificate.

Article 13 The technical inspection of motor vehicle safety, in addition to complying with the national technical standards for motor vehicle safety, shall also conform to the national and municipal standards for environmental protection; if it does not meet the standards, it shall not be subject to corresponding registration or shall not be issued a certification mark.

The traffic management department of the public security organ shall supervise and administer the vehicle safety technology inspection agency according to law.

Article 14 The owner of a motor vehicle that should be scrapped must go through the cancellation formalities in time.

For motor vehicles that should be scrapped, the owner of the motor vehicle must first go through the cancellation formalities of the end-of-life motor vehicle before registering for the newly purchased motor vehicle.

Article 15 The motor vehicles driving on the roads above shall meet the following requirements:

(1) Install a number plate at a predetermined position before and after the motor vehicle, and do not install it upside down or reversely;

(b) Paste the motor vehicle inspection mark, insurance mark, and environmental protection qualified mark in the upper right corner of the front window;

(3) Spraying and magnified the license plate number of the rear of the freight motor vehicles and trailer cars;

(4) The number of quasi-occupied passengers sprayed on both sides of the cabs of large and medium-sized passenger transport vehicles, and if they are engaged in operations, the names and operation numbers of the operating units shall be sprayed;

(5) Cargo cars and trailers with a total mass of 3.5 tons or more shall be equipped with side and rear protective devices in accordance with the regulations;

(6) equipped with effective fire-fighting appliances and reflective faulty vehicle warning signs;

(7) The windows and front and rear windows on both sides of the car body shall not be affixed or sprayed with characters or patterns that impede the sight line of sight, and shall not use mirror-reflective sun-shading film;

(8) Professional work vehicles such as road construction maintenance, sanitation cleaning, facility maintenance and afforestation are in line with national and municipal road safety vehicle safety standards;

(9) Passenger cars, heavy-duty trucks and semi-trailer tractors used for highway operations shall install and use a tachograph that complies with national standards.

Article 16 The owners, managers and drivers of motor vehicles shall, in accordance with the national safety technical standards for motor vehicles and the relevant provisions of this Municipality, repair and maintain the vehicles so as to keep the vehicles in good condition, have a clean and tidy appearance, and discharge qualified.

Article 17 After the periodical safety technical inspection of motor vehicles, the traffic administrative department of the public security organ shall issue a qualified inspection mark for vehicles that meet the national technical standards for motor vehicle safety.

Prior to the inspection of motor vehicle safety technologies, parties who have not received records of illegal road traffic violations shall be dealt with at the prescribed time and place.

Section II Non-motor Vehicles

Article 18 Electric bicycles, manpower tricycles, motor wheelchairs for the disabled, and other non-motor vehicles that should be registered may only be registered on the road after they have been registered by the traffic control department of the public security department and received the license.

Article 19 When applying for non-motor vehicle registration, it shall submit the identity of the vehicle owner and the proof of the origin of the vehicle. When applying for the registration of disabled wheelchairs for persons with disabilities, they shall also submit a certificate of lower limb disability issued by a medical institution designated by the traffic administrative department of the public security organ.

The application for registration of electric bicycles and human tricycles shall comply with the relevant regulations of the Municipal People's Government.

Article 20 Wheelchairs for persons with disabilities can only be transferred to persons with disabilities who meet the prescribed conditions.

Article 21 Where a non-motor vehicle license plate is lost, the owner of the vehicle shall carry his own identity certificate and vehicle, and shall go to the traffic control department of the public security organ for replacement.

Section 3 Motor Vehicle Drivers

Article 22 When applying for a motor vehicle driver's license, the applicant shall provide true, legal and valid certificates and vouchers. If the motor vehicle driver information recorded in the motor vehicle driving license changes, it shall promptly handle the renewal formalities.

Article 23 The driving training and examination of venues and roads shall be conducted at the motor vehicle examination sites that meet the prescribed conditions.

Article 24 This Municipality implements a driving information recording system for motorists.

Drivers holding motor vehicle driving licenses issued by this Municipality or driving motor vehicle driving licenses issued by other provinces and cities to drive motorists registered in this Municipality shall obtain drivers' information cards. The driver's information card records driver's road traffic violations, accident handling, cumulative scores of illegal activities, and other information.

If a driver’s information card is lost or damaged, the cardholder should go to the bank designated by the traffic management department of the public security organ to make a replacement, and use the relevant information in the traffic control department of the public security authority before using it.

When driving a motor vehicle, the driver should carry the driver's information card with him and use it together with the driver's license.

Chapter III Road Access Conditions Article 25 When establishing large-scale public buildings, civil buildings, and other major construction projects, the municipal competent department of traffic shall organize relevant departments to conduct road traffic impact assessment. After the demonstration, projects that have a significant adverse impact on the traffic environment will not be approved by the project management department.

Article 26 When roads are newly built, reconstructed or expanded, traffic lights, traffic signs, markings and other traffic safety facilities shall be designed and accepted at the same time as the roads.

The setting of road traffic signs and markings shall comply with the requirements of road traffic safety and smoothness and national standards, and shall remain clear, eye-catching, accurate and intact.

Article 27 The administrative department of roads and transportation facilities shall, in accordance with the traffic requirements, add, exchange, and update road traffic signals in a timely manner. In order to add, exchange, or update restricted road traffic signals, public announcements should be made in advance and publicized extensively.

Article 28 The construction of public parking lots shall be planned and implemented in a rational manner in accordance with the conditions of roads and in accordance with the principles of safety and smooth flow. The design of a public parking lot construction project shall comply with the national and municipal design standards and specifications. Public parking lots that have been built or put into use shall not be used without authorization or used for other purposes.

Article 29 The traffic management department of the public security organ may determine parking berths for roads within the scope of roads and set road traffic signs and markings in accordance with the city’s road parking berths or if it does not affect road safety or smooth traffic. No unit or individual may set up, occupy or cancel road parking berths.

Article 30 The opening up and adjustment of buses, trams and coaches, tourist car routes or stations shall comply with the requirements of traffic planning and safety, smoothness, and convenient travel. Traffic and other competent authorities shall obtain approval from the traffic management department of the public security organ before approval.

The accumulation of roads, construction operations, and the opening of access roads, and the installation of stairs, gates, advertisements, and other road-occupying actions that affect the safe and smooth road traffic, shall be approved by the traffic administrative department of the public security organ.

Article 31 If construction of a road construction operation is approved, the construction entity shall publicize it to the public in advance and observe the following provisions:

(a) on the approved road section and time;

(2) Set up enclosures around the operation area, set up and turn on the lighting equipment at the enclosure facilities at night, except for the operation of setting traffic signs, transportation facilities, and marking of traffic lines;

(3) to set up construction signs or pay attention to hazard warning signs at locations not less than 50 meters away from the direction of arriving vehicles, and to install reflective construction signs or warning signs at locations not less than 100 meters away from the direction of arrival in the night;

(D) Construction workers wear reflective clothing in accordance with the regulations. When crossing the roadway, pass straight through and pay attention to avoiding passing traffic;

(5) After the construction work is completed, the damaged road surface shall be repaired and the remnants on the site shall be cleared.

Article 32 Motor vehicles and operating personnel who perform maintenance, maintenance and other operations on roads shall abide by the following provisions:

(i) Working hours avoid traffic peaks;

(2) The vehicle shall turn on the yellow marker light and the danger alarm flash light and proceed in the forward direction;

(3) When parking on the carriageway, draw a working area at the work site and set up the fence; during the day, the direction of arrival in the working area shall be no less than 50 meters, and reflective construction shall be provided at a location not less than 100 meters at night. Sign or attention warning sign;

(D) Operating personnel wear reflective clothing in accordance with regulations, when crossing the road, go straight through, pay attention to avoiding passing vehicles.

Article 33. A working vehicle shall use the arrow indicator lights in accordance with the following provisions:

(1) When occupying the left lane operation, turn on the right arrow indicator light to guide the rear vehicle to change lanes to the right;

(2) When occupying the right lane operation, turn on the left arrow indicator light to guide the rear vehicle to change lanes to the left;

(3) When occupying the middle lane operation, turn on the left and right double arrow indicator lamps to guide the rear vehicle to change lanes to the left and right.

Chapter IV Road Regulations

Section 1 General Provisions

Article 34: Vehicles and pedestrians shall go their own way and abide by the following provisions:

(1) Cars, motorcycles, tractors, low-speed trucks, three-wheeled vehicles, and wheeled self-propelled machinery are to be driven on slow lanes on roads with more than two motorized lanes in the same direction; buses must not be in fast lanes. Driving, except when passing ahead of the vehicle;

(2) tractors, low-speed trucks, three-wheel vehicles, wheeled self-propelled vehicles and motorcycles shall be allowed on the roads with main roads and auxiliary roads;

(3) The driver driving a motor vehicle during the training period shall not drive in the fast lane;

(4) When a pedestrian encounters obstacles on the sidewalk and fails to pass normally, and borrows a carriageway, the vehicle shall avoid pedestrians who pass through the road.

Article 35 Vehicle lane change shall not affect the normal passage of other vehicles or pedestrians, and shall abide by the following provisions:

(a) to allow vehicles or pedestrians in the lanes they are driving to take precedence;

(2) Driving in sequence and not changing the motor vehicle lanes frequently;

(3) It is not allowed to continuously alter two or more motor vehicle lanes at one time;

(d) When vehicles in the left and right lanes change to the same lane, the vehicle in the left lane will let the vehicle in the right lane go first.

Article 36 In a bus lane designated for a road, only buses and trams shall be permitted to pass within the prescribed time limit, and other vehicles may not enter the lane; in the event of special circumstances such as traffic control, the traffic police command or traffic The sign indicates that you can use the bus lane to drive.

On the road where bus lanes are designated, buses and trams should be routed within the bus lanes within the prescribed time. Bus and tram should not be driven in the express lane on the road where no bus lane is designated. When you are overtaken by a vehicle in front of you, you must borrow only one adjacent motorized vehicle lane. After you overtake the vehicle in front, you should immediately drive back to the original lane.

Article 37. The taxi station for getting on and off the taxi and the place where the taxi is parked shall be the exclusive parking place for taxis, and other vehicles shall not be occupied.

In the place where the taxis are placed on the upper and lower stations, the taxis can temporarily park the passengers and leave the passengers.

At the place where the taxi stop is set, the taxi can temporarily park the passengers or wait in line.

Article 38 In case of major state or foreign affairs, the traffic management department of the public security organ may take temporary traffic control measures.

Where large-scale mass activities are required and traffic control measures are required by the traffic control department of the public security organ, the traffic control department of the public security organ shall announce to the public three days before taking control measures.

Section 2 Motor Vehicles Regulations

Article 39 Roads on motor vehicles shall not exceed the speeds indicated by speed limit signs and markings; roads with more than two motorway lanes in the same direction; if there are no speed limit signs or markings, the maximum speed of urban roads shall be 70 kilometers. The maximum speed of the roads and highways for enclosed motor vehicles is 80 km/h.

Low-speed trucks, three-wheel cars, tractors, battery cars, wheeled special-purpose vehicles, three-wheeled motorcycles, and mopeds travel on roads at a maximum speed of 30 km/h.

The freight cars, trailer trucks, cargo vehicles carrying dangerous chemicals, motorcycles, sidecars, articulated buses, and trams that carry operators are allowed to travel up to 50 kilometers per hour on city roads. The maximum speed of a closed motor vehicle on a dedicated road and highway is 60 km/h.

Article 40 A motor vehicle shall, when the road is free, has a good line of sight and does not violate the provisions of the road traffic safety laws and regulations, shall continue to operate fast and shall not hinder the passage of the rear vehicle.

Article 41 A motorized vehicle shall turn on headlights, position lights and rear lights during the opening of street lights at night.

When a motor vehicle turns, changes lanes, overtakes, turns, and stops on the curb, the turn signal should be turned on 100m to 50m in advance.

Article 42 A motor vehicle may turn around at the junction or road section where there is a U-turn sign or marking or where no prohibition of a left turn, no U-turn sign or marking is set. When you turn around, you should enter the guide lane in advance or enter the leftmost lane from 150 meters to 50 meters from the turning point, and it must not interfere with the normal passage of pedestrians and other vehicles.

Article 43 A motor vehicle passing a roundabout shall drive in the direction indicated by the arrow. Motor vehicles entering roundabouts should allow motorized vehicles that have been either inside or outside the intersection to advance.

When a motor vehicle passes an intersection that is controlled by a traffic light and encounters a release signal, it shall allow the vehicle that was released prior to this release signal to advance.

Article 44 When a motorized vehicle enters or exits or crosses a road, it shall give priority to vehicles and pedestrians traveling on the road. In the roads with the main road and the auxiliary road, the motor vehicles entering the main road should allow the motor vehicles running on the main road and on the main road to go first. The motor vehicles on the auxiliary road should let the motor vehicles on the main road go first.

Article 45. When a motor vehicle is waiting in front of a parked vehicle or is running slowly, it should stop or wait in order, and must not enter non-motorized lanes, sidewalks, or honking a horn to urge the vehicle or pedestrian.

Article 46 Motor vehicles shall not use dangerous flashes of light during driving, but shall be driven by vehicles hauled and towed by road traffic safety laws and regulations, road vehicles, guards of police vehicles, and vehicles operating under low-visibility meteorological conditions. Article 47 In the event of a breakdown or accident of a motorized vehicle during driving, the emergency warning light should be turned on immediately and a warning sign should be set. Article 48 Towing motor vehicles shall comply with the following provisions:

(1) Both the tractor and the towed vehicle shall be driven by a driver who has obtained the driving license of the motor vehicle for more than one year;

(2) When using a soft-linked traction at night, reflective markers shall be set on the traction device;

(3) If there are two or more motorized lanes on the road, drive in a slow lane;

(4) The main road and the auxiliary road are provided on the road, and they are driven on the auxiliary road;

(5) No trailer-mounted vehicles or vehicles carrying dangerous chemicals shall be towed;

(6) No special wheeled machinery or other wheeled machinery shall be towed.

Article 49 The parking of motor vehicles shall abide by the following provisions:

(1) Parking in the parking berths on the roads prescribed by the parking lot or traffic signs and markings;

(2) Within the parking berths on the road, park along the forward direction and the vehicle body must not exceed the parking berth;

(3) Access to a parking lot or road parking berth by road shall not prevent normal passage of other vehicles or pedestrians.

Article 50 When a motor vehicle temporarily parks on a road, it shall abide by the following provisions:

(1) In the forward direction, the right side of the vehicle body shall be close to the edge of the road and shall not exceed 30 cm. At the same time, the hazard warning flash light shall be turned on;

(2) When the low-visibility meteorological conditions such as wind, rain, snow, fog, etc. occur at night, open the marker lights, rear lights, and fog lights.

Article 51 A bus or tram entering a docking station shall comply with the following provisions:

(i) A single row of parking on the side of the docking station;

(2) It is forbidden to park up and down passengers at places other than stops;

(3) It is not allowed to entertain guests and show guests in the docking station.

Article 52 The test of motor vehicles shall comply with the following provisions:

(1) In accordance with regulations, fly the number plate of the test vehicle issued by the traffic management department of the public security organ;

(2) Driving by a driver who has obtained a motor vehicle driving license for more than one year;

(3) According to the time and route prescribed by the traffic management department of the public security organ;

(4) No person not affiliated with the trial run shall be taken;

(e) No braking tests may be conducted on the road.

Article 53 A police car, a fire engine, an ambulance, and an engineering rescue vehicle may travel in emergency lanes when performing emergency tasks. Other motor vehicles may not drive in emergency lanes.

When a traffic accident or malfunction of a motor vehicle needs to be temporarily parked in the emergency lane, the lights shall be used in accordance with the provisions, and the warning sign of the faulty vehicle shall be set; if the vehicle body exceeds the roadway occupied by the emergency lane, the faulty vehicle warning sign shall be set at the occupied position. Section 3 Regulations for Non-motorized Vehicles, Pedestrians and Passengers

Article 54 When a non-motor vehicle passes an intersection controlled by a traffic light, the following provisions shall be observed:

(1) When the release signal is met, let the vehicle that has released the signal prior to this release go first;

(2) When turning left, turn along the edge of the non-motorized prohibited area or the right side of the intersection;

(3) It is forbidden to drive or park in the non-motorized area;

(4) Non-motor vehicles that have not been released by traffic signals shall not enter the intersection.

Article 55 Driving non-motor vehicles shall comply with the following provisions:

(i) Driving in a non-motorized vehicle in a forward direction. On roads without non-motorized lanes, bicycles and electric bicycles should be within 1.5 meters to the left of the right edge of the road. Human tricycles and disabled wheelchairs should be left at the right edge of the road. When driving within a range of 2.2 meters, the cart should be driven within 2.6 meters from the right edge of the road.

(2) No access to expressways, urban expressways or other closed motor vehicle lanes;

(3) Maintaining a safe distance from the non-motor vehicles driving in the vicinity; avoiding pedestrians on roads mixed with pedestrians;

(d) Avoiding pedestrians when crossing pedestrian crossings;

(5) No parking on the road;

(6) Turn lights are turned on before turning;

(7) Bicycles, electric bicycles, and human tricycle brakes shall not be allowed to ride on roads if they fail;

(8) An adult can carry a child in a fixed seat while driving a bicycle, but it must not carry persons over the age of 12; a minor who drives a bicycle must not carry a person;

(9) Manned passenger tricycles shall be carried according to the authorized number of persons, and manned freight tricycles shall not be carried;

(10) Bicycles, electric bicycles, and tricycles must not ride on sidewalks or crosswalks.

Article 56 The following provisions shall be complied with when driving wheelchairs for persons with disabilities:

(1) Carriage of a motorized wheelchair for disabled persons issued by the traffic management department of the public security organ;

(b) It may carry an accompanying person, but may not operate.

Article 57 Pedestrians and passengers shall abide by the following provisions:

(1) Pedestrians shall walk on sidewalks. Where there are no sidewalks, they shall walk within 1m to the left of the right edge of the road;

(2) Pedestrians are not allowed to enter expressways, urban expressways or other closed motor vehicle lanes;

(3) Pedestrians may not walk on the road or sell or send articles;

(4) It is not allowed to wait for vehicles on the carriageway or to call for operating vehicles;

(5) Pedestrians who are not released shall not enter the intersection when a motor vehicle is released when there is a traffic signal;

(6) Take a bus, tram and long-distance bus and wait at the stop or designated place in turn; wait until the car is stopped;

(7) A motorized vehicle must not affect the driver's safe driving;

(8) No driver shall be allowed to know that the driver is unfit for driving without a driver's license, drinking, or physical exhaustion;

(9) When standing on a cargo motor vehicle, it shall not stand or sit on the carriage board;

(10) When riding a two-wheeled motorcycle, it is only allowed to sit in the back seat;

(11) No electric bicycles, human transport tricycles, or mopeds may be used; bicycles or wheelchairs with disabled persons may not be used in violation of regulations.

Section 4 Special Provisions on Freeways

Article 58 If a motorized vehicle needs to go on a freeway, the driver shall inspect the vehicle's tires, fuel, lubricating oil, brakes, lights, fire extinguishing equipment, and reflective faulty vehicle warning signs in advance, and ensure that it is complete and effective.

Article 59: Expressway rescue vehicles and wreckers shall be installed with warning lights in accordance with standards and shall be painted with clear sign patterns. When performing rescue and troubleshooting tasks, warning light and hazard warning flash should be turned on.

Article 60 The units conducting construction, maintenance, and maintenance operations on the expressway shall, except for routine maintenance and maintenance, conduct the inspection within the time, place, and scope of the approval, and abide by the following provisions:

(1) Set up clear warning signs at 1,000 meters, 500 meters, 300 meters, and 100 meters in the direction from the work site, and set a red warning light (tube) at night;

(2) Workers wear reflective clothing in accordance with the regulations. When crossing the road, pass straight through and pay attention to avoiding passing traffic.

Article 61 In case of natural disasters, severe weather conditions, construction or traffic accidents that seriously affect traffic safety, the expressway management agencies and the traffic management departments of the public security agencies shall inform each other of the situation in a timely manner; the traffic management department of the public security organ may take Limit traffic speeds, change lanes, temporarily interrupt traffic, close highways and other traffic control measures. When traffic control measures are taken, traffic signs or announcements should be issued.

Article 62 The expressway management agency shall ensure that the safety protection facilities of the expressway are complete and effective, timely clear the vehicles and other obstacles that have broken down, and dissuade vehicles with restricted access and pedestrians from entering the expressway from the toll station or service area.

Article 63 The scene of a traffic accident on the expressway shall be cleared by the expressway management organization in time after the investigation work of the traffic management department of the public security organ is completed. When clearing, safety controls shall be implemented in accordance with the provisions of road construction operations.

Article 66 After the site survey is completed, the parties shall, under the organization of the traffic management department of the public security organ, promptly move the vehicle to a place that does not obstruct the traffic and clear the site as required.

In the event of an irresponsibility, inability or enforcement of an emergency affecting the public interest, the traffic management department of the public security organ may appoint a unit to transfer the vehicle to a place where it does not obstruct traffic and clean up the site on behalf of the parties. The parties shall receive and keep articles cleared from the scene.

The provisions of the second paragraph of this Article shall apply to the cleanup of a faulty vehicle.

Article 67 The traffic management department of the public security organ may collect traffic accident vehicles, suspect vehicles, motor vehicle driving licenses, motor vehicle driving licenses, and other evidence relating to traffic accidents according to the needs of inspection and appraisal, and keep them properly. It should be returned immediately after identification.

Article 68 After the traffic management department of the public security organ has investigated, it shall determine the liability of the parties according to the role of the parties’ actions in the occurrence of a traffic accident and the severity of the fault. If the party is at fault, it shall determine the liability of the party; if the party is not at fault, it shall determine that the party has no responsibility.

The responsibilities of parties to a traffic accident are divided into: all responsibilities, major responsibilities, equal responsibilities, minor responsibilities, and no responsibilities:

(1) If one of the parties is at fault, the other party is not at fault, and if there is any fault, it is all responsibility; if there is no fault, there is no responsibility;

(2) The parties above the two parties are at fault, the role and the major faults are the main responsibilities, the roles and the equivalents of the faults are equally responsible, and the effects and the minor faults are secondary responsibilities;

(3) If it is impossible to determine whether the parties are at fault or belong to a traffic accident, all parties are not responsible;

(4) If the party flees, causing changes on the spot, loss of evidence, and the traffic management department of the public security organ is unable to verify the facts of the traffic accident, the escaped party shall be deemed to be wholly responsible; if the party intentionally destroys, falsifies the scene or destroys the evidence, it shall be wholly responsible;

(5) If one party intentionally causes a traffic accident, the other party shall have no responsibility.

The specific determination criteria for the responsibility of parties to traffic accidents are formulated by the traffic management department of the municipal public security organ and announced to the public.

Article 69 This Municipality shall implement a compulsory third party liability insurance system for motor vehicles according to law, and establish a social assistance fund for road traffic accidents.

If a motorized vehicle causes a personal injury or death or property loss due to a traffic accident, if the accident vehicle participates in the compulsory third-party liability insurance for motor vehicles, the insurance company shall make compensation in advance within the limits of the motor vehicle third-party liability compulsory insurance liability; the vehicle involved does not participate in the machine In the case of compulsory third-party liability insurance for motor vehicles, the affected vehicle shall be compensated in accordance with the amount of liability equivalent to compulsory third-party liability insurance.

Article 70 If a traffic accident between motor vehicles causes personal injury or death, or property damage, it exceeds the limit of liability for compulsory insurance for third party liability, and the party in fault shall bear the liability for compensation; if both parties have faults, they shall be proportionate to their respective faults. Article 71 If a traffic accident between non-motor vehicles, non-motor vehicles and pedestrians causes personal injury or death, or property damage, the party in fault shall bear the liability for compensation; if both parties are at fault, they shall bear the proportion of their respective faults. Article 72 Where a traffic accident between a motorized vehicle and a non-motor vehicle or a pedestrian causes personal injury or death, or property damage, the insurance company shall make compensation in advance within the limit of liability for compulsory third-party liability insurance for motor vehicles. If the motor vehicle has any fault, it shall bear the liability for compensation according to the degree of fault.

The loss of traffic accidents between motor vehicles and non-motor vehicles and pedestrians is caused intentionally by the driver and pedestrian of the non-motor vehicle. The motor vehicle party does not bear the liability for compensation; the compulsory third-party liability insurance for motor vehicles has been paid in advance. The insurance company has the right to recover.

Article 73 If a motorized vehicle causes a road traffic accident that causes personal injury or death, property damages, the parties have conditions to report the case, protect the site but do not report the case according to law, and protect the site, so that the basic facts of the accident cannot be ascertained by the insurance company in the third motor vehicle. Responsibility for compulsory insurance covers the amount of compensation within the limit. (2) Traffic accidents between motor vehicles and non-motor vehicles and pedestrians, where the motor vehicle has the above behavior, and there is no evidence to prove that non-motorized vehicles and pedestrians have traffic safety violations, and that motor vehicle drivers have taken the necessary measures for disposal. The traffic management department of the public security organ shall, within five working days from the date of receiving the mediation application form of the party concerned, conduct a review and make a decision. Acceptance of the conditions will be accepted; those who do not meet the conditions will not be accepted, and inform the applicant in writing.

(八)通过铁路道口未按照管理人员指挥通行的;

(九)在车行道内行走或者兜售、发送物品的;

(十)未被交通信号放行的行人进入路口的。

第八十二条乘车人有下列行为之一的,处10元罚款:

(一)违反规定在机动车道上从机动车左侧上下车的;

(二)开关车门时妨碍其他车辆和行人通行的;

(三)在机动车行驶中将身体任何部分伸出车外、跳车的;

(四)乘坐二轮摩托车未在后座正向骑坐的;

(五)乘坐货运机动车时,站立或者坐在车厢栏板上的;

(六)违反规定搭乘自行车、电动自行车、人力货运三轮车、残疾人机动轮椅车和轻便摩托车的。

第八十三条行人、乘车人有下列行为之一的,处20元罚款:

(一)行人违反限制通行规定的;

(二)乘车人向车外抛撒物品的;

(三)乘车人影响驾驶人安全驾驶的;

(四)乘车人未按照规定使用安全带的。

第八十四条未满16周岁在道路上驾驭畜力车、驾驶电动自行车和残疾人机动轮椅车的,予以警告或者处10元罚款。

第八十五条驾驶非机动车有下列行为之一的,处20元罚款:

(一)违反交通信号通行的;

(二)违反限制通行规定的;

(三)在非机动车道内逆向行驶或者违反规定在机动车道上行驶、停车滞留的;

(四)违反路口通行规定的;

(五)在人行道、人行横道上骑行的;

(六)未按照规定横过机动车道的;

(七)行经人行横道未避让行人的;

(八)突然猛拐或者在其他车辆之间穿行的;

(九)扶身并行、互相追逐或者曲折竞驶的;

(十)牵引、攀扶车辆或者被其他车辆牵引,双手离把或者手中持物的;

第八十六条驾驶非机动车有下列行为之一的,处20元罚款:

(一)未依法登记上路行驶的;

(三)违反载人规定的;

(四)独轮自行车、二人以上骑行的自行车上道路行驶的;

(五)在道路上学习驾驶的;

(六)驾驶残疾人机动轮椅车未携带行驶证的;

(七)未按照规定地点停放的。

第八十七条驾驭畜力车有下列行为之一的,处20元罚款:

(一)违反限制通行规定的;

(二)未按照规定下车牵引牲畜的;

(三)未按照规定超车的;

(四)并行或者驾驭人离开车辆的;

(五)使用未驯服牲畜驾车、随车幼畜未拴系的;

(六)停放车辆时未拉紧车闸、拴系牲畜的。

第八十八条非机动车驾驶人、行人和乘车人有下列行为之一的,处50元罚款:

(一)非机动车、行人进入高速公路、城市快速路或者其他封闭的机动车专用道的;

(二)醉酒驾驶非机动车的;

(三)驾驶残疾人机动轮椅车、电动自行车最高时速超过15公里的;

(四)非下肢残疾的人驾驶残疾人机动轮椅车的;

(五)乘坐摩托车未按照规定佩戴安全头盔的;

(六)乘车人携带易燃易爆危险品的;

(七)明知驾驶人无驾驶证、饮酒或者身体疲劳不宜驾驶机动车而乘坐的;

(八)自行车、三轮车加装动力装置的。

对自行车、三轮车加装动力装置的,除给予罚款处罚外,责令拆除加装的动力装置并予以收缴。

第八十九条驾驶机动车有下列情形之一的,处50元罚款:

(一)未按照规定使用安全带的;

(二)驾驶摩托车未按照规定佩戴安全头盔的;

(三)车门、车厢未关好时行车的;

(四)未配备有效的灭火器具、反光的故障车警告标志的;

(五)进出停车场或者道路停车泊位妨碍其他车辆或者行人正常通行的。

第九十条驾驶机动车有下列情形之一的,处100元罚款:

(一)未携带行驶证、驾驶证、驾驶人信息卡的;

(二)驾驶证丢失、损毁期间驾驶机动车的;

(三)驾驶摩托车时手离车把或者在车把上悬挂物品的;

(四)在机动车驾驶室的前后窗范围内悬挂、放置或者粘贴、喷涂妨碍安全驾驶的物品或者文字、图案的;

(五)公路营运客车、重型货车、半挂牵引车未按照规定安装或者使用行驶记录仪的;

(六)未按照规定粘贴或者悬挂实习标志的;

(七)道路施工养护、环卫清扫、设施维修及绿化等专业作业车辆不符合国家和本市的道路作业车辆安全标准的。

第九十一条驾驶机动车有下列情形之一的,处100元罚款:

(一)在没有划分中心线和机动车、非机动车分道线的道路上,未按照规定行驶的;

(二)违反分道行驶规定的;

(三)未按照交通标志、标线指示或者交通警察指挥行驶的;

(四)违反限制通行规定的;

(九)违反试车规定的;

(十)违反灯光使用规定的;

(十二)违反故障机动车牵引规定的;

(十三)向道路上抛撒物品的;

(十四)违反规定使用喇叭的;

(十五)机动车发生故障,未按照规定报警的。

第九十二条驾驶机动车有下列情形之一的,处100元罚款:

(一)行经交叉路口、环形路口、道路出入口或者进出、穿越道路未按照规定行车、停车或者让行的;

(二)通过无交通信号控制路口未减速让行的;

(三)通过无交通信号或者无管理人员的铁路道口未减速或者停车确认安全的;

(四)行经无交通信号的道路,遇行人横过道路未按照规定避让的。

第九十三条机动车载人、载物有下列情形之一的,处100元罚款:

(一)非公路客运车辆载人超过核定人数未达到20%的;

(二)驾驶摩托车违反规定载人的;

(三)驾驶拖拉机违反规定载人的;

(四)载客汽车违反规定载货的;

(五)违反规定标准载物的;

(六)运载超限的不可解体物品,未按照公安机关交通管理部门的规定行驶的。

第九十四条驾驶机动车有下列情形之一的,处200元罚款:

(一)驾驶安全设施不齐全的车辆上道路行驶的;

(二)驾驶机件不符合机动车国家安全技术标准的机动车上道路行驶的;

(三)服用国家管制的精神药品或者麻醉药品后驾驶机动车的;

(四)患有妨碍安全驾驶机动车的疾病仍驾驶机动车的;

(五)使用他人机动车驾驶证、驾驶人信息卡的。

第九十五条驾驶机动车有下列情形之一的,处200元罚款:

(一)未悬挂机动车号牌或者未取得机动车移动证明、未按照移动证明载明的有效期限、行驶区域行驶的;

(二)未按照规定安装号牌的;

(三)故意遮挡或者污损机动车号牌的;

(四)机动车号牌不清晰或者不完整的;

(五)改变车身颜色、更换发动机、更换车身或者车架,未办理变更登记的;

(六)货运机动车及其挂车的车身或者车厢后未喷涂放大的牌号、放大的牌号不清晰的;

(七)大、中型客运机动车未按照规定喷涂准乘人数或者经营单位名称的;

(八)驾驶未按照规定期限进行安全技术检验或者未放置有效的检验合格标志、保险标志、环保合格标志的;

(九)变更车道影响本车道内机动车正常行驶的;

(十)行经人行横道遇行人通过时,未停车让行的;

(十一)超过规定时速50%以下的;

(十二)非公路客运车辆载人超过核定人数达到20%以上的;

(十三)货运机动车违反规定附载作业人员的;

(十四)运载危险化学品未按照规定行驶的;

(十五)通过铁路道口,违反交通信号或者管理人员指挥的;

(十六)载运超限物品行经铁路道口,未按照当地铁路部门指定的铁路道口、时间通过的;

(十七)遇有执行紧急任务的警车、消防车、救护车、工程救险车未按照规定让行的。

第九十七条驾驶机动车有下列情形之一的,处200元罚款:

(一)拨打、接听电话、观看电视的;

(二)下陡坡时熄火或者空档滑行的;

(三)连续驾驶超过4个小时,未停车休息或者停车休息时间少于20分钟的;

(四)警车、消防车、救护车、工程救险车违反规定使用警报器、标志灯具的;

(五)违反规定在应急车道内行驶或者停车的。

第九十八条遇前方道路受阻或者前方车辆排队等候、缓慢行驶时,驾驶机动车有下列情形之一的,处200元罚款:

(一)违反规定进入路口的;

(二)违反规定在人行横道或者网状线区域内停车等候的;

(三)借道超车的;

(四)占用对面车道的;

(五)穿插等候车辆的;

(六)进入非机动车道、人行道行驶的。

第九十九条驾驶机动车有下列情形之一的,处200元罚款:

(一)违反规定停放车辆的;

(二)违反规定临时停车的;

(三)出租汽车违反规定停车上下乘客的;

(四)出租汽车违反规定在道路上停车待客、揽客的;

(五)公共汽车、电车违反驶入停靠站规定的。

第一百条驾驶机动车发生故障或者事故,有下列情形之一的,处200元罚款:

(一)未按照规定开启危险报警闪光灯的;

(二)未按照规定设置警告标志的;

(三)夜间未开启示廓灯和后位灯的;

(四)发生交通事故后,未按照规定撤离现场,造成交通堵塞的;

(五)机动车发生故障后尚能移动,未移至不妨碍交通地点的。

第一百零一条学习驾驶或者实习期间驾驶机动车,有下列行为之一的,处200元罚款:

(一)未按照指定路线、时间学习驾驶或者教练车乘坐无关人员的;

(二)在实习期间内驾驶禁止驾驶的机动车的;

(三)在实习期间内驾驶机动车在快速车道内行驶的。

第一百零二条机动车在高速公路、城市快速路行驶,有下列行为之一的,处200元罚款:

(一)驾驶禁止驶入高速公路的机动车驶入高速公路的;

(二)非救援车、清障车在高速公路上拖曳、牵引机动车的;

(三)救援车、清障车执行救援、清障任务时,未开启示警灯和危险报警闪光灯的;

(四)行驶速度低于规定的最低时速的;

(五)未按照规定保持行车间距的;

(六)低能见度气象条件下未按照规定行驶的;

(七)倒车、逆行、穿越中央分隔带掉头或者在车行道内停车的;

(八)在匝道、加速车道或者减速车道上超车的;

(九)骑、轧车行道分界线或者在路肩上行驶的;

(十)试车或者学习驾驶机动车的;

(十一)货运机动车车厢内载人的;

(十二)二轮摩托车载人的。

第一百零三条违反本办法第二十九条规定的,由公安机关交通管理部门责令停止违法行为,恢复原状。

第一百零四条违反本办法第三十一条、第三十二条、第六十条规定的,由公安机关交通管理部门责令施工作业单位立即改正,消除道路交通安全隐患;不能立即消除隐患的,责令停止作业。

第一百零五条违反本办法第七十六条规定,未履行道路交通安全防范责任制度的,由公安机关交通管理部门责令限期改正;逾期不改正的,禁止其机动车上道路行驶。

第一百零六条对依法应当给予罚款处罚的机动车驾驶人,由交通警察将其交通违法信息录入驾驶人信息卡,并出具行政处罚决定书。机动车驾驶人应当在收到行政处罚决定书之日起15日内,持驾驶人信息卡、处罚决定书到公安机关交通管理部门指定的银行缴纳罚款;当事人也可以自愿采取银行信用卡划拨的方式缴纳罚款。

第一百零七条公安机关交通管理部门对交通技术监控记录资料确认的交通违法行为,应当向社会公示,公众有权查阅。

公安机关交通管理部门及其交通警察发现机动车有未处理的违法行为记录的,应当书面告知机动车所有人或者驾驶人,机动车所有人或者驾驶人应当按照告知的时间、地点接受处理。

第八章附则第一百零八条本办法自2005年1月1日起施行。
